Public Schools Must Teach Gay Marriage

I've posted on this before, and I'll do so again. This time we quote directly from California Eduction Code section 51890(1)(D). If Prop. 8 fails, California public school teachers will forever be under state mandate to teach same-sex marriage. It doesn't say give it equal time, it says pupils will receive instruction in "the legal and financial aspects and responsibilities of marriage and parenthood." Because the definition of marriage has changed, albeit by court fiat, this statute requires that instruction must also change to include it.
51890.  (a) For the purposes of this chapter, "comprehensive health
education programs" are defined as all educational programs offered
in kindergarten and grades 1 to 12, inclusive, in the public school
system, including in-class and out-of-class activities designed to
ensure that:
   (1) Pupils will receive instruction to aid them in making
decisions in matters of personal, family, and community health, to
include the following subjects:

   (A) The use of health care services and products.
   (B) Mental and emotional health and development.
   (C) Drug use and misuse, including the misuse of tobacco and
alcohol.
   (D) Family health and child development, including the legal and
financial aspects and responsibilities of marriage and parenthood
.
   (E) Oral health, vision, and hearing.
   (F) Nutrition, which may include related topics such as obesity
and diabetes.
   (G) Exercise, rest, and posture.
   (H) Diseases and disorders, including sickle cell anemia and
related genetic diseases and disorders.
   (I) Environmental health and safety.
   (J) Community health.

Homophobia?? No. Homosexual Fear of Reason

"Ken, the Playful Walrus" has posted an interesting critique of the latest L.A. Times Prop. 8 nonsense. http://walrus.blogtownhall.com/2008/08/14/the_%E2%80%98black_vote%E2%80%99_and_proposition_8.thtml The Times editorial tries to deflate the idea that Blacks are more likely to vote against same-sex marriage and for Prop. 8 than are Whites. The Times thinks it is showing that Blacks are not as "homophobic" as is stereotypically thought. Ken ridicules the misuse of the word "homophobia," and by implication, the misuse of the suffix, "-phobia."

Somewhere along the way, "-phobia" took on the ubiquity of "-gate," as in Watergate, Rathergate, gate, gate, gate. Any Washington scandal is a "gate." Similarly, the Left and some libertarians use -phobia against any principle, view or attitude that stands in its way. This-o-phobia, that-o-phobia. Now, homophobia. As Ken satirizes, though, "phobia" denotes irrational fear of something. Crowds, close spaces, spiders, whatever. Freaking out beyond the measure of the threat.

But nothing is or can be more irrational than homosexual union. Biologically it doesn't stack up. Tab A does not go into Slot B. The gear isn't meant for each other; the digestive tract and reproductive systems are not complimentary. Moreover, if everybody practiced it, the human race would go extinct. Psychologically it's off-kilter, too. Nature provided the opposite sexes to make a balanced whole, a complete family unit where its two parents hopefully mitigate each others' weaknesses and adopt each others' strengths, little by little. Men and women are insufficient but necessary components of the whole. Nature, the human race, and children cry out for this complimentary variety, not for the imbalanced and sterile sameness of homosexual union. Homosexual partners are missing something that cannot ever be fulfilled in the way they seek.

Nothing grounded in reason promotes surrender to homosexual urges, especially in the form of legal union and marriage. Nothing so irrational as homosexual union can serve as any sort of moral or practical foundation for the human family.

It is the homosexual-marriage lobby that has the true phobia, the fear of reason.

Lutheran Church Statement in Support of Marriage

I intend to link to and quote from as many pro-marriage church statements as possible. Today's is from the Lutheran Church, Missouri Synod to which a good friend belongs. http://www.lcms.org/pages/internal.asp?NavID=13613 It gives me strength to see others holding firm against the tides of the age. We are stronger together. If marriage is to be preserved, it must be together. From the Lutheran Statement denouncing the California Supreme Court's Marriage Cases:
The recent decision of the California Supreme Court legalizing same-sex “marriage” highlights the downward spiral of moral values that is becoming so prevalent in our culture. This most recent action contravenes not only the Judeo-Christian values that have defined the moral compass of this great nation, but also the laws of nature and the natural reproductive process.

In the face of such moral decline, The Lutheran Church—Missouri Synod (LCMS) has consistently upheld the Bible-based values that designate “marriage as the lifelong union of one man and one woman (Genesis 2:2–24; Matthew 19:5–6)” .... The LCMS has consistently held that “homosexual behavior is prohibited in the Old and New Testaments [of Holy Scripture] (Leviticus 18:22, 24; 20:13; 1 Corinthians 6:9–20; 1 Timothy 1:10) as contrary to the Creator's design (Romans 1:26–27).”

As a Christian body in this country, the LCMS has the duty and responsibility to speak publicly in disagreement with this action of the California Supreme Court. In the present context we cannot be silent, since such silence “could be viewed as acceptance of the homosexual lifestyle.” Accordingly, we as a church body urge our leaders, members, congregations, and all Christians, “to give a public witness from Scripture against the social acceptance and legal recognition of homosexual 'marriage.'”
The statement goes on to urge Christlike love toward the sinner, as do other, similar statements. I hope those of us engaged in the grass roots effort to save marriage encounter Lutherans and others who are taking up their duty "to give a public witness" on this great issue.

LDS Explanation Against Same-Sex Marriage

The LDS Church recently published a lengthy explanation for its unequivocal support of traditional marriage, and its opposition to same-sex marriage, or to anything else that undermines marriage. http://newsroom.lds.org/ldsnewsroom/eng/commentary/the-divine-institution-of-marriage The statement is lengthy, so I'll post from it periodically, in bite-sized excerpts. Key paragraphs:
Marriage between a man and a woman is central to the plan of salvation. The sacred nature of marriage is closely linked to the power of procreation. Only a man and a woman together have the natural biological capacity to conceive children. This power of procreation – to create life and bring God’s spirit children into the world – is sacred and precious. Misuse of this power undermines the institution of the family and thereby weakens the social fabric.[4] Strong families serve as the fundamental institution for transmitting to future generations the moral strengths, traditions, and values that sustain civilization. As the Universal Declaration of Human Rights affirms, “The family is the natural and fundamental group unit of society.”[5]

Marriage is not primarily a contract between individuals to ratify their affections and provide for mutual obligations. Rather, marriage and family are vital instruments for rearing children and teaching them to become responsible adults. While governments did not invent marriage, throughout the ages governments of all types have recognized and affirmed marriage as an essential institution in preserving social stability and perpetuating life itself. Hence, regardless of whether marriages were performed as a religious rite or a civil ceremony, married couples in almost every culture have been granted special privileges aimed primarily at sustaining their relationship and promoting the environment in which children are reared. A husband and a wife do not receive these privileges to elevate them above any other two people who may share a residence or social tie, but rather in order to preserve, protect, and defend the all-important institutions of marriage and family.

It is true that some couples who marry will not have children, either by choice or because of infertility, but the special status of marriage is nonetheless closely linked to the inherent powers and responsibilities of procreation, and to the inherent differences between the genders. Co-habitation under any guise or title is not a sufficient reason for defining new forms of marriage.

How California Really Got Same-Sex Marriage

Back in May, just after the California Supreme Court decided the Marriage Cases, the L.A. Times published this profile on Chief Justice Ron George. http://articles.latimes.com/2008/may/18/local/me-gay18 Assuming the Times reported accurately, Chief Justice George seemed to let some of his guard down, slightly, and for just a moment, about his own feelings and motives on the same-sex marriage issue. This unexpected paragraph startled me, probably more for its candor than anything. I expected this sort of thing to be kept close to the vest, at least for a while.
George, who grew up in Los Angeles, said he counts gays among his friends. Four years ago, he peered out his chambers’ windows across from San Francisco City Hall to watch gay couples lining up to marry. He saw the showers of rice, the popping of champagne corks, the euphoria of the couples.
Nothing like a little context.

Or perspective. One man's feelings swing his reason. That one man swings a court case. The court case swings the law. The law swings the culture. And civilization. Maybe.

No Appeal Against Jerry Brown's Sabotage

Jerry Brown's rewording of Proposition 8's ballot title and summary--phrased negatively to spoil Prop. 8's chances--will stand. http://www.sfgate.com/cgi-bin/article.cgi?f=/c/a/2008/08/12/BADU128V6V.DTL Protect Marriage will not appeal the Superior Court ruling upholding Brown's intentional sabotage. I don't know why there will be no appeal, although it probably was a long shot. The one interesting thing was that in 50 years, there had been no ballot summary phrased negatively... until this one.

California Seen by Homosexual Activists as Pivotal

This Sacramento Bee column highlights the nearly five-year old experience Massachusetts has had with homosexual marriage. That state has had a four year head start on California and has solemnized about 11,000 marriages. Yet,
While gay marriage is firmly entrenched in Massachusetts, gay activists in the Bay State say the future of the movement nationally could well depend on what happens in California.
Boy, I'll say. We know it and they know it, and everybody who cares to know it, knows it. As I said in a previous post, this Proposition 8 is taking on a decisive role in defining marriage, not just for California, but for the nation.

Harry Jaffa on the Immorality of Homosexual Union

Perhaps nobody has better explained the reasons to oppose public acceptance of same-sex marriage than Harry Jaffa, professor emeritus from Claremont McKenna's School of Government, and now Distinguished Fellow of conservative think tank, the Claremont Institute. Jaffa is most famous for his writings on Lincoln and the Declaration of Independence, but he writes prolifically on nearly any subject that could affect the American way of life. He is the rare political philosopher who cares about the actual consequences of ideas. I'm going to begin sharing excerpts of things he has said about same-sex marriage and about associated ideas. This first excerpt comes from Claremont Review of Books, a 1991 book review, where Jaffa examined a book entitled Gays/Justice: A Study of Ethics, Society and Law, by Richard Mohr. http://www.claremont.org/publications/pubid.484/pub_detail.asp Jaffa debunked the homosexual author's moral relativism and then explained the bedrock reasons--moral principles--that civilization cannot abide publicly endorsed homosexual union. Key excerpts:
Consider that a man is a species-being, and the species to which he belongs — the species that defines his nature — is both rational and social. Man cannot live at all — much less live well — except by the mutual protection and mutual support of other human beings. Morality refers to those rules that mankind has learned, both from reason and experience, are necessary for surviving and prospering. The inclination of many men — what we might call the inclination of their lower nature — to take their sex where they find it and ignore the consequences, must be subordinated to their higher nature, which includes the interest of society (and the interest of nature in the species). For in no other species are the young so helplessly dependent for so long. Hence the importance, even for survival, of the laws both moral and civil governing the institution of marriage and of the family. We know that the relaxation of these laws leads to disorder, disease, and death, no less surely in the most advanced cultures than in the most primitive. But the good of the family is not merely self-preservation and survival, but the higher good — the happiness — of all its members, including those whose original horizon may not have extended beyond immediate gratification.
Morality must be based on man's "higher nature," which necessarily includes that behavior that is best for the species, not just the individual. A moral man must therefore bridle his personal passions, not only for society's happiness, but also for his own. Jaffa goes on to explain the moral kinship of incest and homosexual union; both are bad because they are bad for the human family and for human happiness. All else that's bad gets cursed too... the easy divorce culture, adultery, and gay bathhouse behavior.
The dissolution of the family is at the root of nearly all the social problems afflicting contemporary American society. The high rate of divorce is making emotional cripples out of children at all levels of society. And the children of divorce become divorced themselves at much higher rates than others. Crime, drug abuse, alcoholism, mental illness, venereal disease, low educational achievement, lack of job related skills, inability to function well on jobs, all of these things — and many more — are due at least partly to the disintegration of the traditional family. And at the root of the disability of the American family is the ethic that says that sexual gratification is and should be only a matter of personal preference and personal choice. The traditional family, the embodiment and expression of "the laws of nature and nature's God," as the foundation of a free society, has become merely one of many "alternative lifestyles."
Those of us who realize all this and advocate to preserve traditional marriage often hear, "Yes, but modern science makes up for some of these consequences." Jaffa counters:
The reigning assumption is that it is the function of science to emancipate human behavior from the restraints of nature. But it is by no means clear that is possible in the long run. There was a time in the 1960's when antibiotics appeared to have conquered syphilis. Together with the the birth control pill, this seems to have promoted an increase in heterosexual promiscuity. It would certainly seem that nature had an interest in the morality that is conducive to the family, and punishes behavior inimical to it. I would suggest therefore that the quest for a cure of AIDS, unaccompanied by any attempt to modify the behavior out of which AIDS was generated, is ultimately futile. I would venture to suggest that if a cure for AIDS were discovered tomorrow, it would not be very long before a new venereal disease would make its appearance, just as herpes did in the 60s and AIDS did in the 80s. What is needed above all is not a medical miracle cure but a moral and behavioral change.
Ronald Reagan said facts are stubborn things. Jaffa teaches that nature is a stubborn thing. Happiness is only possible in conformance with it.

Down the Rabbit Hole With the L.A. Times

The L.A. Times editorialized today from its left-most soapbox, urging its remaining three readers to vote "no" on Proposition 8 and in favor of same-sex marriage. http://articles.latimes.com/2008/08/08/editorial_pages/ed-marriage8 The Times agreed that Proposition 8 consisted of:
[t]he same sentence as [Prop. 22] in 2000: “Only marriage between a man and a woman is valid or recognized in California.” Yet the issue that will be put before voters Nov. 4 is radically different. This time, the wording would be used to rescind an existing constitutional right to marry. We fervently hope that voters, whatever their personal or religious convictions, will shudder at such a step and vote no on Proposition 8.
The times goes on to pay great deference and homage to the preexisting "right" suddenly protected by the California State Constitution. Guess what. It's not really there. The California Supreme Court admitted as much in its In re Marriage Cases opinion. The nutshell summary of that opinion was this, and I kid you not: We the Court realize the citizens passed Prop. 22 defining marriage between a man and a woman. We also realize that before that, marriage in California had always been so defined in various other statutes. Even more, although the state Constitution never expressly addressed the issue, it, too, has always recognized marriage in California as between a man and a woman. HOWEVER, since Prop. 22, the state went and passed other laws allowing same-sex civil unions. After passing those laws, the state passed more laws ever increasing the rights of same sex union partners. Now, here's the kicker, the Court held that because Californians have been so merciful and granted so many rights to same-sex union partners, it has now become unconstitutional under California's equal protection clause for California law--read Prop. 22--to deny marriage to same-sex couples. Put another way, because California gave an inch, the same-sex marriage crowd was able to seize a thousand miles. And yet another: give a little, lose all.

Back to the L.A. Times editorial, which never discusses any of this judicial legerdemain by a bare 4-3 majority. Preexisting right my foot. Same-sex marriage was just barely concocted, and the ink is barely dry on the May 15, 2008 judicial opinion. It is one of the very worst court decisions I have ever read, not only for its moral obtuseness, but also for its sleight of hand. In my view, the civil union statutes should have been ruled illegal after Prop. 22. They were a blatant end run around the will of the people expressed in a duly passed voter initiative. Nevertheless, Californians adapted, and, in their tolerant way, lived and let live. But then the California Supreme Court used that very tolerance as the linchpin for its new opinion remaking the definition of marriage. So how dare the Times accuse good citizens of seeking to destroy an "existing constitutional right," when, in fact, they are seeking to restrain a new monster the California Supreme Court has just created and turned loose. The marriage decision trampled the true rights of the many to govern themselves according to good and true principles, in order to cater to the license of the few. In all of human history, there has never been such a "right" until now. The Times' logic would protect the new monster over the community in which it's been turned loose. The People seek only to restore the exclusive primacy of heterosexual marriage that has ever been its due. After all, it is the very spring water of human existence.

Sacramento Court Backs Jerry Brown's Sabotage

A Sacramento Superior Court today upheld Jerry Brown's sabotage rewording of Proposition 8's title and summary ballot language. http://www.sacbee.com/102/story/1142913.html He did it to frame the issue negatively and repel a certain percentage of California voters. The superior court is not the last word. There is a Court of Appeal this can go to, and then to the California Supreme Court. I don't know the law well in this area, but my guess is the only hope is that the Court of Appeal does something different and that the state Supreme Court decline to mess with that holding. In other words, it's a longshot, and we're probably stuck with the obnoxious rewording of the ballot language.

So what. We'll win, anyway.

This is a Myth vs. Fact snippet from the ProtectMarriage.com website. It's the kind of thing Prop. 8 proponents must internalize and be ready to say to friends, neighbors and contacts at a moment's notice.
MYTH: Allowing gay couples to legally marry does not affect
anyone else.
 
FACT: The narrow decision of the State Supreme Court effectively renders all civil marriage
meaningless and will result in tremendous confusion for children. The state Education Code
(§51890) requires that teachers instruct children as young as kindergartners about marriage. If
the gay marriage ruling becomes permanent, teachers will have little choice but to teach young
children there is no difference between gay marriage and traditional marriage
.
 
We should not accept a court decision that results in public school teachers teaching our kids
that gay marriage is acceptable. That is an issue for parents to discuss with their children
according to their own values and beliefs. It should not be forced on us against our will.
You can launch the discussion this way, when appropriate:  "Did you know that state law requires school teachers to instruct students about marriage?  And that includes kindergarten..."

Hugh Hewitt Champions Proposition 8

Proposition 8 leader Ron Prentice was on at the end of the second hour of Hugh Hewitt's talk radio show yesterday. They discussed the financial needs of the pro-marriage campaign and decided it was going to take at least $30 million dollars for traditional marriage to prevail, although Hugh wondered whether that would be enough given the bullying tactics of the left. Those tactics include boycotts of pro-Prop. 8 donors. They specifically discussed Doug Manchester's San Diego hotels, and Hugh encouraged his audience to stay at one next time they visit San Diego. I know I will. But an even more sinister a tactic is this... Prop. 8 opponents are now contacting donors' employers and informing them their employees are donating to the hateful pro-Prop. 8 campaign. They'll stop at nothing. Good news from Prentice, though: ProtectMarriage.com just received a check for $1 million and another for a half million.

Hats off to Hugh, who has jumped on board protecting marriage wholeheartedly. He has done pro-Proposition 8 ads for the cause. He rightly views Prop. 8 as a national issue, and I expect him to cover the issue better than any other regular on-air source. If you're not a regular listener, start listening.
